Day 2 Court Update: Justice Engages Deeply – Sovereignty Rights Affirmed in Court

by Alberta Prosperity Project

November 20, 2025 – Day 2 of the hearings wrapped up on a high note today in the Court of King’s Bench in Edmonton (Law Courts Building, 1A Sir Winston Churchill Square). Jeffrey Rath was on his feet all day, confidently answering every question from Justice Colin Feasby and clearly demonstrating why our referendum question is fully within Alberta’s constitutional rights.

The exact question under review – the one we’re fighting to put before Albertans – is:

“Do you agree that Alberta shall become a Sovereign Country and cease to be a province in Canada?”

Jeffrey showed how the Supreme Court of Canada’s 1998 Secession Reference confirms that independence referenda are part of Canada’s constitutional order. Albertans have the democratic right to ask this direct question, and a clear majority triggers a constitutional duty to negotiate in good faith.

Jeffrey Rath, Constitutional Lawyer for the Alberta Prosperity Project:

“It was a really great day in Court today! Justice Feasby had lots of questions and we were able to explain to him how the Supreme Court of Canada has made it clear that Independence Referenda are part of the Canadian constitutional order!” — Jeffrey Rath, Constitutional Lawyer for APP

Justice Feasby’s thoughtful engagement reflects how seriously the Court is treating the democratic voice of Albertans. Tomorrow, Friday November 21, is the final scheduled day of argument. We’ll bring you the wrap-up as soon as court adjourns.

Thousands of Albertans have already pledged their support. If you’re with us, add your voice now:

Alberta’s future is in our hands. Let’s finish this week strong.
