November 21, 2025 – The final day of hearings concluded today in the Court of King’s Bench in Edmonton (Law Courts Building, 1A Sir Winston Churchill Square). Jeffrey Rath delivered closing submissions with clarity and force, leaving Justice Colin Feasby in no doubt about the constitutional path forward.
The question before the Court remains:
“Do you agree that Alberta shall become a Sovereign Country and cease to be a province in Canada?”
Jeffrey Rath, Constitutional Lawyer for the Alberta Prosperity Project, summed up the case as the hearing wrapped:
“The Alberta Independence Referendum Case wrapped up today in Edmonton. Justice Feasby was left with a clear view of the chaos that would arise if he ignored the Supreme Court of Canada in the Secession Reference. To find that holding a lawful referendum on Independence could ‘contravene’ anyone’s rights would be a departure from the rule of law that could bring the administration of Justice in Alberta into disrepute.” — Jeffrey Rath, Constitutional Lawyer for APP
The 1998 Secession Reference is unambiguous: Albertans have the democratic right to ask a clear question about sovereignty. A clear majority would trigger a constitutional duty to negotiate — full stop.
Arguments are now complete. Justice Feasby has reserved his decision — we expect a ruling in the coming weeks.
